Privacy Policy

Summary

We collect what we need to run your account: your contact details, your targeting information, your Instagram login, and payment details handled by Stripe. Your Instagram credentials are seen only by the account managers assigned to you, are never sold or shared, and are removed within 30 days after you cancel. We use Google and Meta tracking on this website for advertising, and you can opt out. We do not sell your personal information.

This Privacy Policy explains how Bali Media, LLC, doing business as SpectSocial ("SpectSocial," "we," "us," or "our"), collects, uses, shares, and protects information when you visit spectsocial.com (the "Site"), contact us, or use our Instagram growth management services (the "Services"). It also explains the choices you have.

By using the Site or the Services you agree to this Privacy Policy. If you do not agree, please do not use them.

1. Information We Collect

Information you give us

  • Contact and account details. Name, email address, phone number, business name, website, and the Instagram username of each account we manage.
  • Instagram login credentials. Because our account managers work inside your Instagram account, we collect your Instagram username and password and, if you use two factor authentication, the codes needed to complete login. See Section 4 for how we protect these.
  • Targeting and onboarding information. Details about your business, goals, ideal audience, competitors, locations, hashtags, and the message you want us to send to new followers.
  • Payment information. Your payment card details are collected and stored by our payment processor, Stripe. We receive your name, billing address, the last four digits and brand of your card, and your transaction history. We do not store your full card number.
  • Communications. Emails, form submissions, support requests, reviews, and any other messages you send us.

Information collected automatically

  • Device and usage data. IP address, browser type, device type, operating system, referring pages, pages viewed, time on page, and similar data collected through cookies and similar technologies when you visit the Site.
  • Advertising and analytics data. Through tools such as Google Tag Manager and the Meta Pixel, we and our advertising partners may collect information about your visit, including the pages you view and actions you take, to measure our advertising and show you relevant ads on other platforms. See Section 6.

Information from your Instagram account. While providing the Services we see information available inside your Instagram account, such as your followers, engagement, direct messages, and analytics. We use this only to perform and report on the Services.

Information from third parties. We may receive information from platforms where you leave a review (such as Trustpilot), from advertising platforms (such as Meta and Google) about how you found us, and from our customer relationship management provider.

2. How We Use Information

We use the information we collect to:

  • Provide the Services, including building your targeting, engaging with Instagram users from your account, sending your Direct Message Outreach message, and reporting to you.
  • Set up, manage, and secure your account and subscription, and process payments.
  • Communicate with you about onboarding, billing, support, and changes to the Services or our policies.
  • Send marketing emails about our Services, offers, and content. You can unsubscribe at any time.
  • Operate, improve, and secure the Site and the Services, and understand how visitors use the Site.
  • Measure and improve our advertising, including showing ads to people who have visited the Site.
  • Comply with law, enforce our Terms of Service, and protect our rights, our customers, and others.

3. How We Share Information

We do not sell your personal information for money. We share information only as described here.

Service providers. We use third party companies to run our business. They may process your information on our behalf and are permitted to use it only to provide services to us. They currently include:

  • Stripe for payment processing.
  • GoHighLevel for our customer relationship management, email, forms, scheduling, and, if we offer it, text messaging.
  • Webflow for hosting the Site and processing website form submissions.
  • Google (Google Tag Manager and related Google services) for tag management, analytics, and advertising.
  • Meta Platforms (Meta Pixel and Meta Ads) for advertising measurement and delivery.
  • Email, cloud storage, and productivity providers we use to operate the business.

Our team. Your Instagram credentials and targeting information are shared with the SpectSocial account managers assigned to your account. We do not use outside contractors or third party agencies to manage client accounts.

Advertising partners. Data collected through the Meta Pixel and Google tags may be shared with Meta and Google for targeted advertising. Under some state privacy laws this may be considered "sharing" or "targeted advertising." You can opt out as described in Section 6 and Section 9.

Legal and safety. We may disclose information if required by law, subpoena, or court order, or if we believe disclosure is necessary to protect the rights, property, or safety of SpectSocial, our customers, or others.

Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will require the recipient to honor this Privacy Policy.

With your consent. We share information for any other purpose only with your permission, for example when you approve a testimonial for use on the Site.

4. How We Protect Your Instagram Credentials

Your Instagram login is the most sensitive information we hold, and we treat it that way.

  • Credentials are stored in a secured system with access limited to the account managers assigned to your account and the personnel needed to supervise them.
  • Credentials are used only to perform the Services described in our Terms of Service. We do not change your password, remove your recovery information, post or delete your content, or access other services connected to your Instagram login.
  • We do not sell, rent, or share your credentials with any third party.
  • When your subscription ends, we remove your credentials from our systems within 30 days. We recommend that you also change your Instagram password after your subscription ends.
  • If we become aware of a security incident that affects your credentials, we will notify you promptly by email and tell you what steps to take.

You can revoke our access at any time by changing your password. If you do so while subscribed, please let us know so we can pause the Services rather than trigger security prompts on your account.

5. Data Retention

We keep personal information for as long as needed for the purposes described in this Privacy Policy, including to provide the Services, maintain business records, resolve disputes, and comply with legal obligations. As a general rule:

  • Instagram credentials are removed within 30 days after your subscription ends.
  • Account, onboarding, and communication records are kept for up to 3 years after your subscription ends, unless a longer period is required by law.
  • Payment and tax records are kept as required by law, generally 7 years.
  • Website analytics data is retained according to the settings of the tools we use, typically 2 to 26 months.

6. Cookies, Pixels, and Advertising

The Site uses cookies and similar technologies. Some are necessary for the Site to work. Others help us understand how the Site is used or allow us to advertise to people who have visited.

Tools we use

  • Google Tag Manager loads and manages other tags on the Site, including analytics and advertising tags.
  • Meta Pixel allows Meta to match Site visitors with their Facebook and Instagram accounts so we can measure our ads and show ads to people who visited the Site. Meta may also use this data according to its own privacy policy.
  • Google advertising and analytics tags may be used for the same purposes on Google's platforms.
  • GoHighLevel may place cookies to track form submissions and link your visit to your customer record.

Your choices

  • Most browsers let you block or delete cookies through their settings. Blocking cookies may affect how the Site works.
  • You can control ads based on your interests through Meta's Ad Preferences in your Facebook or Instagram settings, and through Google's Ads Settings at adssettings.google.com.
  • You can install the Google Analytics opt out browser add on.
  • You can opt out of interest based advertising from many companies at optout.aboutads.info and optout.networkadvertising.org.
  • We honor Global Privacy Control signals where required by law.

We do not currently respond to browser "Do Not Track" signals because there is no common standard for them.

7. Email and Text Message Communications

Email. We send transactional emails about your account, billing, and the Services to every customer. We send marketing emails only where permitted, and every marketing email includes an unsubscribe link.

Text messages. If you opt in to receive text messages from us, we may send messages about your account, onboarding, support, and, if you separately agree, promotions. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, and you can get help by replying HELP or emailing admin@spectsocial.com. Consent to marketing texts is not a condition of purchase.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for providers acting on our behalf to deliver the messages.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including secured credential storage, limited access, and encryption in transit. No method of storage or transmission is completely secure, so we cannot guarantee absolute security. Please use a strong, unique password for your Instagram account and enable two factor authentication.

9. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights regarding your personal information:

  • Access. Request a copy of the personal information we hold about you.
  • Correction. Ask us to correct inaccurate information.
  • Deletion. Ask us to delete your personal information, subject to legal exceptions.
  • Portability. Receive your information in a usable format.
  • Opt out of sale, sharing, or targeted advertising. Ask us not to share your information with advertising partners for targeted advertising. You can also use the tools in Section 6.
  • Non discrimination. We will not treat you differently for exercising these rights.

To exercise any of these rights, email admin@spectsocial.com with the subject line "Privacy Request." We will need to verify your identity, usually by confirming the email address or Instagram username on your account. You may use an authorized agent to make a request if the agent provides proof of your authorization. If we decline a request, you may appeal by replying to our response.

We extend these rights to all customers regardless of where they live, even where the law does not require it.

California residents. The California Consumer Privacy Act, as amended by the California Privacy Rights Act, may give you additional rights, including the right to know what categories of personal information we collect and disclose and the right to limit the use of sensitive personal information. In the past 12 months we have collected the categories of information described in Section 1 and disclosed them to the categories of recipients described in Section 3. We do not knowingly sell personal information. We do not use or disclose sensitive personal information, including Instagram credentials, for any purpose other than providing the Services you requested.

Residents of other states. If you live in a state with a comprehensive privacy law, such as Colorado, Connecticut, Virginia, Texas, Oregon, or others, you have similar rights, and the process above applies.

10. Children

The Site and the Services are for adults and businesses. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, contact us and we will delete it.

11. Users Outside the United States

SpectSocial is based in the United States and our Services are directed to customers in the United States. If you use the Site or the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your country. By using the Site or the Services you consent to this transfer. If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with data protection laws, you may have additional rights under those laws, and you can contact us to exercise them.

12. Third Party Sites and Platforms

The Site links to third party sites and platforms, including Instagram, Trustpilot, and Stripe. Their privacy practices are governed by their own policies, not this one. Your use of Instagram is governed by Meta's terms and privacy policy.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version on the Site and change the effective date. If a change materially affects how we use your information, we will make reasonable efforts to notify current customers by email before it takes effect.
